Remove Conditions on Residence
WHEN TO REMOVE CONDITIONS FROM YOUR GREEN CARD
A conditional Green Card is issued by USCIS to foreigners who obtain permanent residency in the United States either through marriage to a U.S. citizen or as an investor. This Green Card is valid for two years and requires the holder to request the removal of conditions to obtain a permanent Green Card valid for ten years. These are the most common situations for requesting the removal of conditions:
You are nearing the end of your two-year period as a conditional resident.
- The application to remove conditions must be made within the 90 days prior to the expiration of your conditional Green Card.
Significant change in circumstances.
- If there are significant changes in your marital situation, such as a divorce or the death of a spouse, you may need to apply to remove conditions under different grounds, and perhaps sooner than planned.
Error in card issuance.
- If your conditional Green Card contains printing errors or other incorrect information, you will need to request a correction at the same time you ask for the removal of conditions.
