HOW TO OFFER A GREEN CARD TO A SPOUSE
The Green Card based on marriage allows the spouse of a U.S. citizen or Green Card holder to live and work anywhere in the United States. The Green Card holder will have “permanent resident” status until they apply for U.S. citizenship, for which they will be eligible after three years if the marriage is still valid.
If you entered the United States with a visa and married a U.S. citizen after 90 days, you are likely eligible to apply for an adjustment of status to legal permanent resident without having to leave the United States. Approximately one year after submitting your application, you and your spouse will need to attend a Green Card marriage interview with USCIS.
If the marriage is less than two years old when the Green Card is granted, it will expire in two years. The couple will need to file a new petition within 90 days before the Green Card expires. This way, the foreign-born spouse can obtain a ten-year Green Card.
The U.S. citizen or permanent resident will need to show that they can be their financial sponsor. If they cannot demonstrate income, they will need a financial co-sponsor who can demonstrate the minimum income required by the government.
